Nothing in our Services constitutes financial advice, investment advice, trading advice, or any other type of advice. We are not a registered investment advisor, broker-dealer, or financial institution. You should not make any financial decision based solely on information provided by our Services. 6. Intellectual Property Rights

For purchases made directly through our website, please contact us at contact@robustdevs.tech within 14 days of purchase to request a refund. Refunds are granted at our sole discretion.

By using TradeSight AI and making in-app purchases, you consent to our sharing of data regarding your usage and consumption of purchased content with Apple, as part of our efforts to resolve refund requests. This information may include details about how you have accessed and interacted with purchased content. Such data sharing is done in compliance with Apple's policies and only as necessary to process refund requests.

9. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, disclose, and protect your personal information. By using our Services, you consent to our collection and use of your information as described in our Privacy Policy.

9.1 Data Security

We implement reasonable security measures to protect your information. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

Your use or inability to use our Services
Unauthorized access to or alteration of your transmissions or data

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. Accordingly, some of the limitations above may not apply to you.

Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent or stop a breach or threatened breach of these Terms.

14. Apple App Store Requirements

If you access our Services through an application downloaded from the Apple App Store, the following additional terms apply:

14.1 Acknowledgment

You acknowledge that these Terms are between you and Mohammad Sajjadur Rahman only, and not with Apple Inc. ("Apple"). Mohammad Sajjadur Rahman, not Apple, is solely responsible for our Services and the content thereof.

14.2 Scope of License

Your license to use our application is limited to a non-transferable license to use the application on an Apple-branded product that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

14.3 Maintenance and Support

Mohammad Sajjadur Rahman is solely responsible for providing any maintenance and support services for our application. Apple has no obligation to furnish any maintenance or support services.

14.4 Warranty

Mohammad Sajjadur Rahman is solely responsible for any product warranties, whether express or implied by law. In the event of any failure of our application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to our application.

14.5 Product Claims

Mohammad Sajjadur Rahman, not Apple, is responsible for addressing any claims relating to our application or your possession or use thereof, including: (a) product liability claims; (b) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation.

14.6 Intellectual Property Rights

In the event of any third-party claim that our application or your possession and use of our application infringes that third party's intellectual property rights, Mohammad Sajjadur Rahman, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

14.7 Legal Compliance

You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

14.8 Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

15. Google Play Store Requirements

If you access our Services through an application downloaded from the Google Play Store, the following additional terms apply:

You acknowledge that our application complies with Google Play's Content Policies and Developer Program Policies.

15.3 Updates

16. Export Controls

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce. You represent and warrant that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government list of prohibited or restricted parties.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be replaced with a valid, legal, and enforceable provision that most closely reflects the original intent.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Mohammad Sajjadur Rahman.
